This End User License Agreement (“Agreement”) governs use of MCE Toolbox (“the Software”), an internal application owned and operated by Martin Control & Equipment Co., Inc. (“Martin Control”). By accessing or using the Software, the user agrees to the terms below.
1. Internal use only
The Software is provided exclusively for use by authorized employees of Martin Control & Equipment Co., Inc. in the course of their work. It is not licensed, sold, or made available to the public or to any third party. Access requires valid Martin Control company credentials.
2. License
Martin Control grants each authorized employee a limited, non-transferable, revocable right to use the Software for internal business purposes only, for as long as they remain authorized. All rights in the Software not expressly granted are reserved by Martin Control.
3. Acceptable use
Users agree to use the Software only for legitimate Martin Control business purposes and in compliance with company policy and applicable law. Users may not attempt to access data they are not authorized to view, share their access with unauthorized persons, or use the Software to circumvent any system controls.
4. Read-only operation
The Software accesses connected business systems, including QuickBooks Online and Google Workspace, on a read-only basis. It is designed to retrieve and summarize information, not to create, modify, delete, or transmit records in those systems. Any customer- or vendor-facing message produced by the Software is a draft for human review and is not sent by the Software.
5. Data
Use of the Software is also governed by the Martin Control Privacy Policy, which describes what information the Software accesses and how it is handled.
6. No warranty
The Software is provided “as is,” without warranties of any kind. Martin Control does not warrant that the Software will be error-free or uninterrupted, and answers generated by the Software should be verified by the user before being relied upon for business decisions.
7. Limitation of liability
To the fullest extent permitted by law, Martin Control & Equipment Co., Inc. shall not be liable for any indirect, incidental, or consequential damages arising from use of the Software.
8. Changes and termination
Martin Control may modify, suspend, or discontinue the Software, or revoke any user’s access, at any time and without notice. Continued use after any change constitutes acceptance of the revised terms.
